Additional Change to Vacation Carryover for 2020

Each year, all eligible employees must reduce their vacation balance in accordance with Lab policy. In March 2020, Brookhaven Science Associates (BSA) announced that:
- the cutoff date for the carryover of vacation days for exempt and non-exempt monthly paid employees and members of the United Steelworkers (USW) and Suffolk County Security Police Association (SPFPA) unions was extended from March 20, 2020, to July 20, 2020;
- vacation time accrued between March 21, 2020, and July 20, 2020, does not count toward the allowed carryover balance in July 2020;
- such carryover is only for the purpose of accrued vacation time in excess of 20 days (160 hours) as of March 20, 2020;
- members of the International Brotherhood of Electrical Workers (IBEW) on site were not impacted by this change as they are on a different vacation schedule.

Upon review of current COVID-19 pandemic guidance for social distancing, an accounting of employee use of vacation time, and feedback gathered by the line organizations, BSA recognizes that employees have not been able to use their accrued vacation time due to stay-at-home orders, significant workloads, or both. For many employees, taking time off has not been an option.

EXTENDED 2020 VACATION CARRYOVER CUTOFF DATES
As the pandemic continues and the Lab is not yet back to full operational status on site, we are further extending the 2020 vacation carryover cutoff dates as follows:

- Exempt, Non-exempt (non-union), and Non-exempt (SPFPA &USW unions) employees are normally allowed to carry over 20 days. Under normal circumstances, they would have had to use any days in excess of 20 by March 20, 2020*. The new date by which these days must by used is July 20, 2021.

- Non-exempt (IBEW union) employees are normally allowed to carry over 31 days. Under normal circumstances, they would have had to use any days in excess of 31 by Sept. 17, 2020. The new date by which these days must be used is Sept. 17, 2021.

- Firefighters (IBEW union) are allowed normally allowed to carry over 43.4 days. Under normal circumstances, they would have had to use any days in excess of 43.4 by Sept. 17, 2020. The new date by which these days must be used is Sept. 17, 2021.


*     This date was previously extended to July 20, 2020.


FOR FURTHER CLARIFICATION
- Exempt, Non-exempt (non-union), and Non-exempt (SPFPA & USW unions) employees may carry over all accrued vacation time through March 20, 2021, without forfeiture. An employee's total accrued vacation time will be determined as of March 20, 2021. If it is in excess of 20 days (160 hours), the employee will have until July 20, 2021, to use such excess days. Otherwise, such excess vacation time will be forfeited as of July 20, 2021. Vacation accruals between March 21, 2021, and July 20, 2021, will not be included in such forfeiture.

- Non-exempt (IBEW union) and Firefighters (IBEW union) employees may carry over all accrued vacation time through Sept. 17, 2021, without forfeiture. An employee's total accrued vacation time will be determined as of Sept. 17, 2021. If it is in excess of 31 days (248 hours) for Non-exempt (IBEW union) and 43.4 days (347.2 hours) for Firefighters (IBEW union), then such excess vacation time will be forfeited as of Sept. 17, 2021. 

The cutoff dates for the carryover of vacation days will revert to the previously established March 20 and Sept. 17 cutoff dates, as applicable, thereafter.
